| This work involves :- |
- Advising as to when a General Power of Attorney may be necessary, and what it can be used for, and how.
- Advising whether the simple Section 10 power or a more comprehensive or specific power may be required
- Advising the donor of the power the implications of giving the power to someone else to act for them
- Advising on the limitations of a General Power of Attorney
- Taking details and drafting the appropriate document - the proposed attorneys, any restrictions or limited purposes to be considered
- Arranging for the Attorneys to sign the documents where necessary
- Reporting to the client on completion of the work and advising on safekeeping of the original documents

| The particular skills required for this work include; |
- Understanding of Powers of Attorney generally and the Powers of Attorney Act 1971 in particular
- Understanding the Law of Agency
- Understanding the limitations of a general power of attorney, its duration and the circumstances in which it will not be effective
- Understanding how General Powers of Attorney relate to trustee issues, in particular the Trustee Delegation Act 1999 s1 and Trustee Act 1925 s25 and Trusts of Land and Appointment of Trustees Act 1996 s 9
