This work involves :-
advising people (not necessarily elderly but primarily) as to what may be required to manage their affairs in the event that they lose the ability to cope themselves. Assessing the client to determine if they have the necessary level of understanding to give instructions and to appreciate the implications of what they are proposing to do. Taking details for Lasting Powers of Attorney if appropriate – advising as to the need for Financial and Property and/or Health and Welfare Powers. discussing with clients the proposed Attorney/s, their roles, any limitations or guidance to be given to them, and any substitutes to be appointed. advising on the procedure and carrying it out – drafting the document. seeing the client to go through the documents personally and (if agreed) acting as their “Certificate Provider”. arranging for the Attorneys to sign the documents serving the required notices on nominated persons registering the documents at the Office of the Public Guardian reporting to the client on completion and advising on safekeeping of the original documents
The particular skills required for this work include;
empathetic approach to clients: ability to assess mental capacity knowledge of compliance with and application of the Mental Health Code of Practice and legally approved methods of ascertaining mental capacity meticulous preparation of documents the ability to explain their complexities to the ordinary person clear sense of the professional relationship with the client and awareness of any outside family influences.
