We will review with you whether a letter of claim as a first step to Court proceedings is the best way to seek payment, or if the debt is over £750, if a statutory demand as the first step to bankruptcy/winding-up may be the best tactic.

Funding your case and “no win, no fee”
You will understand that the work done for you in a litigation case has to be paid for and that you will normally be expected to meet the legal charges and expenses of your own case.
 
If we are not able to settle your claim by negotiation we might advise you to issue Court proceedings. The usual rule in litigation is that costs follow the event, so that the losing party pays the winning party’s reasonable costs and expenses of pursuing the claim. Even if you are successful, the other party may not be ordered to pay all your charges and expenses or these may not be recovered from them in full. Similarly, if Court proceedings are issued and you lose or discontinue your case, you would generally be liable to pay your opponent’s reasonable legal costs. 
There are, however, a number of funding options that may be available to you, both to cover your own costs and to seek to protect you against any cost order being made against you if you are unsuccessful.
 
Sometime it is possible to fund your claim by a Conditional Fee Agreement (‘CFA’), which is more commonly known as “no win – no fee” and we may be able to offer this arrangement to you, depending on the details of your claim. 
 
If we consider that your case is suitable for this arrangement, if you win your claim you pay our basic charges, our disbursements and a success fee. The amount is not based on or limited by any compensation you may receive. You can claim from your opponent part or all of our basic charges, our disbursements and a success fee. If you lose, you pay your opponent’s charges and disbursements. You may be able to take out an insurance policy against this risk. If you lose, you do not pay our charges but we may require you to pay our disbursements.
