When a couple decide to separate, but don’t necessarily feel they are ready for divorce, it may be wise to enter into a Separation Agreement.

A Separation Agreement can also be entered into by unmarried couples. A Separation Agreement will record how financial matters will be dealt with, to include the division of property and or assets and perhaps maintenance.

A Separation Agreement will carry a lot of weight with the Court if proceedings become disputed in the future, providing the agreement has been entered into freely, with the benefit of independent legal advice and after financial disclosure.

Again, like Pre-Nuptial agreements, a Separation Agreement will not automatically bind the Court as only a Court Order can be binding.
